These Terms of Service ("Terms") govern your access to and use of bsehockey.com and your purchase of products from BSE Hockey Co. ("BSE Hockey," "we," "us," or "our").

By using this website or placing an order with BSE Hockey, you agree to these Terms.

1. Online Store

Our online store is operated using Shopify.

You may not use our website or products for any unlawful purpose or in violation of any applicable law.

You agree not to interfere with the operation or security of the website, attempt unauthorized access to our systems, introduce malicious code, scrape the website in a manner that materially disrupts its operation, or use the website to infringe the rights of BSE Hockey or another person.

2. Eligibility to Purchase

You represent that you have legal capacity to enter into a purchase agreement or that you are making the purchase with the authorization of a parent, legal guardian, or other person legally capable of entering into the transaction.

3. Product Information

We attempt to describe our products as accurately as reasonably possible.

Because many BSE Hockey products involve carbon-fiber construction, manufacturing tolerances, surface finishes, custom graphics, and made-to-order specifications, minor variations may occur between individual products.

Photographs, renderings, graphics, colors, weights, dimensions, and other representations on the website are intended to assist customers but may not reproduce every characteristic of a finished product exactly.

Unless expressly stated otherwise, listed product weights should be understood as target or nominal specifications subject to reasonable manufacturing tolerances.

4. Hockey Stick Configurations

Customers are responsible for reviewing the configuration selected before submitting an order.

Available options may include characteristics such as:

• Handedness;

• Flex;

• Curve;

• Length;

• Kick point;

• Weight; and

• Other product specifications.

Some options may only be available through an advanced or "Expert" ordering mode.

Where BSE Hockey identifies a product configuration as carrying increased durability risk, reduced warranty coverage, or no warranty, completing the purchase constitutes acknowledgment of that disclosure.

5. Prices

Prices are shown in U.S. dollars unless otherwise stated.

Applicable taxes, delivery charges, shipping charges, and other charges will be displayed during checkout when applicable.

We may change prices at any time, but a price change will not alter the purchase price of an order already accepted by BSE Hockey unless required to correct an obvious pricing error.

6. Orders

Submitting an order does not necessarily constitute final acceptance by BSE Hockey.

We reserve the right to reject or cancel an order before fulfillment for legitimate business reasons, including:

• A product configuration that cannot be manufactured;

• An obvious pricing or website error;

• Suspected fraud or unauthorized payment activity;

• An order outside our supported fulfillment area;

• Material or manufacturing unavailability; or

• Other circumstances that prevent us from reasonably fulfilling the order.

If we cancel an order after payment has been collected, we will refund the applicable amount paid for the cancelled portion of the order.

7. Made-to-Order Products

Many BSE Hockey products are manufactured after the customer places an order.

Estimated production or delivery times are estimates and are not guaranteed unless BSE Hockey expressly agrees otherwise in writing.

Once production has begun, changes or cancellations may not be possible.

8. Returns, Refunds, and Warranty

Returns, refunds, and warranty claims are governed by our Return and Refund Policy, which is incorporated into these Terms by reference.

Unless otherwise stated, qualifying products include a 30-day limited manufacturing-defect warranty beginning on the date of delivery to the original purchaser.

Certain products or configurations may expressly be sold without warranty coverage.

9. Hockey Is an Impact Sport

Ice hockey and related activities involve inherent risks of injury and equipment damage.

No hockey stick is indestructible.

Product failure alone does not necessarily establish a manufacturing defect. Hockey sticks can be damaged or broken through normal game play, impacts, slashes, blocked shots, collisions, misuse, or accumulated wear.

Customers are responsible for inspecting equipment and discontinuing use if the product shows damage that may make continued use unsafe.

Nothing in these Terms is intended to waive or limit rights or liabilities that cannot legally be waived or limited.

10. Product Modifications

Cutting, drilling, sanding, altering, repairing, or otherwise modifying a BSE Hockey product may affect its performance, durability, and warranty eligibility.

BSE Hockey is not responsible for damage caused by unauthorized modifications.

11. Intellectual Property

The BSE Hockey name, BSE Hockey logos, product names, artwork, website design, text, photographs, graphics, product designs, and other original content are owned by BSE Hockey or used by BSE Hockey with permission, except where otherwise indicated.

Nothing on this website grants permission to reproduce, distribute, manufacture from, commercially exploit, or otherwise use BSE Hockey intellectual property without prior written authorization.

Third-party trademarks, team names, logos, and other intellectual property remain the property of their respective owners.

The appearance of third-party names or marks does not imply sponsorship, authorization, affiliation, or endorsement unless expressly stated.

12. User Submissions

If you submit reviews, photographs, feedback, suggestions, product ideas, or other material to BSE Hockey, you represent that you have the right to submit that material.

You may not submit unlawful, defamatory, infringing, fraudulent, threatening, or malicious content.

Any separate rights granted to BSE Hockey to use customer photographs, testimonials, or other submitted material will be governed by the terms presented when that material is collected or by a separate agreement.

13. Third-Party Services

Our website may use or link to services operated by third parties, including Shopify, payment processors, social networks, analytics providers, and other technology providers.

Those services may be governed by their own terms and privacy practices.

BSE Hockey is not responsible for third-party websites or services that we do not control.

14. Errors and Availability

We reserve the right to correct typographical errors, inaccurate product information, configuration errors, pricing errors, and other mistakes appearing on the website.

Product availability and configuration availability may change without notice.

15. Disclaimer of Warranties

Except for any express written warranty provided by BSE Hockey and to the fullest extent permitted by applicable law, products and website services are provided without additional warranties, representations, or guarantees, whether express or implied.

Nothing in this provision excludes warranties or consumer rights that cannot legally be excluded.

16. Limitation of Liability

To the fullest extent permitted by applicable law, BSE Hockey will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website or purchase or use of our products.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold BSE Hockey harmless from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the website, violation of these Terms, or infringement of another person's rights.

18. Severability

If any provision of these Terms is determined to be unlawful or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

19. No Waiver

Failure by BSE Hockey to enforce a provision of these Terms does not waive our right to enforce that provision in the future.

20. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.

21. Changes to These Terms

We may update these Terms from time to time.

The current version will be posted on this website with its effective or last-updated date.

Changes will apply prospectively unless applicable law requires otherwise.
